Small Claims Proceedings in California

With over 20 years of experience in helping clients prepare legal documents specific to many areas of law, I am highly qualified and ready to assist with preparing for your legal documents.

 

All Small Claims services we offer are all based on flat, low-cost fees. Before filing a Small Claims case, you must first make a written demand on the individual how has caused you to suffer damages or loss. If you are unsuccessful at collecting following a written demand, you may then file a Small Claims action and seek a Court Judgment in your favor. Upon successfully acquiring a Small Claims Judgment in your favor, the other party is given a set time to satisfy the judgment. If not satisfied within the ordered time, you may seek court assistance from the court in collecting on your judgment. Post Judgment court involvement includes Money Judgment Writ, Judgment Debtor Examination, Bank Levy / Wage Garnishment Order, and Judgment Renewals.

 

The most common Small Claims cases involve:

  • Property damage or physical injury expenses related to a vehicle accident. 

  • Landlord/tenant security deposit disputes; loss suffered as a result of property damage 

  • Repair disputes with contractors or mechanics

  • Collecting a defaulted financial agreement

 

There are pros and cons to filing a Small Claims Action. 

 

The pros include:

  • Bring the matter to a conclusion relatively quickly,

  • Proceedings are relatively informal, and the rules of evidence are not overly strict.

  • Lawyers are not needed or permitted.

 

The Cons Include:

  • The Defendant only (not the Plaintiff) can appeal an unfavorable judgment in the Superior Court,

  • You must clearly and effectively support/explain your position to the judge,

  • Limitations on amounts you may seek.

 

Limitation of amounts you may seek in Small Claims Court. As an individual or sole proprietor, you may seek up to $10,000. If you are a corporation or business, your action will be limited to $5,000. Additionally, you may be limited to the number of cases you may file each year. You may file a maximum of 2 cases per calendar year where to total claim is greater than $2,500. However, you may file an unlimited number of cases totaling $2,500 or less.
