At first glance, any member of the public might not initially recognize the tremendous value a Legal Document Assistant (LDA) can be to them as they begin their legal process. To understand the importance of a Legal Document Assistant, you must know the definition of an LDA. Business and Professions Code 6400(a) defines a Legal Document Assistant as "A person who…. provides self-help services to a member of the public who is representing themselves in a legal matter…." See unabridged Code (Here). Next, you must be aware of the definition of "Self-Help Services." Business and Professions Code 6400(d)(1) states, "Completing Legal documents in a ministerial manner, selected by a person who is representing themselves in a legal matter, by typing or otherwise completing the documents at the person's specific request."
The above paragraph notwithstanding, an LDA may provide published factual information that has been written or approved by an attorney pertaining to legal procedures, rights, or obligations to a person who is representing themselves in a legal matter to assist the person representing themselves. An LDA may also make published legal documents available to a person representing themselves in a legal case. Finally, an LDA may file and serve legal forms and documents at the specific direction of a person representing themselves.
However, it is essential to note that according to Business and Professions Code 6400(g), "A Legal Document Assistant May Not provide any kind of advice, explanation, opinion, or recommendation to a consumer about possible legal rights, remedies, defenses, options, selection of forms, or strategies."
